These terms govern your use of the cweihan website and any services I provide. By using my website or engaging me, you agree to these terms.
This page is a starter template and must be reviewed by a qualified solicitor before going live with client traffic. A separate Master Services Agreement (MSA) and Statement of Work (SOW) governs each project.
1. Use of website
You may use this website for personal and business reference. You may not copy, scrape, redistribute, or commercially exploit any content without written permission.
2. Services
Services I offer are described on the website. Specific scope, deliverables, timelines, and pricing are defined in each Statement of Work (SOW). The SOW takes precedence over website descriptions.
3. Payment
Projects: 50% upfront, 50% on launch. Care Plans: monthly in advance via automatic charge. Late payments (more than 14 days overdue) incur a 5% fee.
4. Cancellation and refunds
- Before design starts: full refund of deposit
- Before launch: 50% refund of total fee
- Post-launch: no refund unless I breach a written guarantee
- Care Plans: 30 days written notice; no partial-month refunds
5. Intellectual property
On final payment, you own the delivered website code, content, domain, and hosting accounts. I retain rights to my internal libraries, templates, and processes. I may showcase the project in my portfolio unless I agree otherwise in writing.
6. Client responsibilities
- Provide timely feedback (within 3 working days)
- Supply content, brand assets, and credentials as agreed
- Pay invoices on agreed schedule
- Inform me promptly if your business or contact details change
7. Warranties and liability
I deliver work with reasonable skill and care. I do not warrant rankings, traffic, or revenue outcomes. These depend on factors beyond my control. My total liability for any claim is limited to the fees you paid me in the preceding 6 months.
8. Termination
Either party may terminate for material breach with 14 days written notice (uncured). On termination, you owe for work completed to date.
9. Governing law
These terms are governed by Malaysian law. Disputes are subject to the exclusive jurisdiction of the Malaysian courts.
